ONLINE PRIVACY POLICY
and COOKIE DISCLOSURE STATEMENT
Lyon Living
respects your privacy.
Lyon Management Group, Inc., doing business as Lyon Living, understands
that your privacy is important. We want
you to know what personal information we collect about you online.
In this Online Privacy Policy and Cookie Disclosure Statement, “we” and
“our” refer to Lyon Living. “You” refers
to you, an individual.
Information
we collect from you online.
We operate many websites. When you
visit any of our websites, our web servers will collect the name of the domain
you used to access the Internet, as well as your computer’s Internet Protocol
(IP) address, information about your device identifier, and your general
location based on your IP address. We also
will collect information about the pages of our websites that you visit, the
time and date of your visit, the time you spend on those pages, the website you
came from and visit next, and other diagnostic data. We collect this information through the use
of analytics cookies. We use this
information to evaluate the performance of our websites, to evaluate our
marketing campaigns, and to audit our websites for security purposes.
Our websites also offer several ways in which you can voluntarily provide
personally identifiable information to us.
For instance, we collect the information you provide to us when you
submit it to us through our “Resident Portal” or our “Investor Portal,” when
you complete forms available through our “Contact Community” feature, or when
you answer
surveys. This information may include
your first and last name, home or other physical address, e-mail address,
telephone number, and other information that allows us to identify you and
contact you for the purpose of providing the products and services you have
requested from us. We may also use this
information to market our products and services to you.
Our
websites use Cookies.
Cookies are files with a small amount of data (text files) which may
include an anonymous unique identifier. When
you visit our websites, our server asks your browser to store cookies on your
device in order to remember information about you, such as your language
preferences or login information. Those
cookies are set by us and are called first-party cookies.
We also use third-party cookies, which are cookies from a domain other
than our domain. These cookies are set
for our advertising and marketing efforts.
Third-party cookies are used for cross-site tracking, retargeting and ad
serving.
Some browsers (Apple’s Safari, Mozilla’s Firefox and Brave) block
third-party cookies by default.
Microsoft’s Edge and Google’s Chrome browsers offer tools for users to
refuse or limit cookies.
Our websites use the following types of cookies:
·
Strictly Necessary
Cookies. These are
cookies that are required for the operation of our websites and for you to be
able to complete services you request.
They include, for example, cookies that enable you to log into secure
areas of our websites.
·
Functional Cookies. Functional cookies hep to
perform certain functionalities like sharing the content of the website on
social media platforms, collect feedbacks, play videos, and other third-party
features.
·
Analytics Cookies. Analytics cookies are used to
understand how visitors interact with our websites. These cookies help provide information on
metrics such as the number of visitors, bounce rate, traffic source,
conversions, etc. Our websites use
Google Analytics to help us evaluate the performance of our website and to give
us information about how online visitors use and interact with our
website. Google Analytics collects
online identifiers, the time of visit, pages visited, time spent on each page,
referring site details, IP addresses and device identifiers to track and
monitor the use of our websites. Google
Analytics shares this data with other Google services. Google may use the collected data to
contextualize and personalize the ads of its own advertising network. You can opt-out of having your data from being
collected and used by Google Analytics by installing the Google Analytics
opt-out browser add-on (compatible with Chrome, Safari, Firefox and Microsoft
Edge). The Google Analytics opt-out
browser add-on is available at https://tools.google.com/dlpage/gaoptout. To learn more about how Google uses
information from sites or apps that use its service, please see Google’s
Privacy Policy, which is accessible here:
https://policies.google.com/privacy.
·
Performance Cookies. Performance cookies are used to
understand and analyze the key performance indices of the website which help in
delivering a better user experience.
·
Advertisement and Social
Media Cookies. Our
websites use advertisement and social media cookies (or “plugins”) to share
website content and user activity on our website with advertising networks and with
social media platforms (e.g., Facebook, Instagram, LinkedIn and Twitter). These cookies track visitors across websites
and collect information to provide customized and relevant advertisements.
If
you don’t want cookies, you can adjust your browser settings.
Some browsers
(such as Apple’s Safari and Mozilla’s Firefox) automatically block third-party
cookies. Google Chrome allows
third-party cookies by default, although it has announced it will block those
cookies in 2022. Most web browsers let
you choose whether to accept cookies. Most also let you delete cookies already set.
The choices available, and the mechanism used, will vary from browser to
browser. Such browser settings are typically found in the “options”, “tools” or
“preferences” menu. You may also consult the browser’s “help” menu.
We
may share the information we collect from you online.
In some
circumstances, it is necessary for us to share information we collect from you with
third parties for our business purposes and for other reasons as permitted by
law. The categories of third persons
with whom we share your information are:
· Disclosure to
Communities.
Some of the most important features of our websites require us to share your
personal information with the Community in which you reside. For instance, when you provide personal
information through the Site as part of a “New Resident Login” account, or
through the “Resident Portal” or similar form, we will share your personal
information with the Community where you are a resident. By entering your
personal information in this context and clicking the “SUBMIT” or similar
button, you are directing us to share your personal information in this manner.
Your Community may use your information to contact you. Please be advised that we do not monitor or
control Communities’ use or disclosure of your personal information.
· Disclosure to
Service Providers. We work with third parties who provide
services that may include, but are not necessarily limited to, website hosting,
data analysis, email services, and other services of an administrative or
technical nature. In addition, we work
with third parties who improve, maintain and repair the properties in the
Communities, and who provide other services, such as security. We reserve the right to share personal
information with such third parties for the purpose of providing such services
to us.
· Disclosure to
Third Parties. We share information about your use of our
website and information we gather from you online with Google and social media
platforms so they can contextualize and
personalize the ads of its own advertising network
· Other
Disclosures.
We reserve the right to disclose personal information to third parties as
permitted and required by law.
You
can correct information we gather about you online.
If you entered
information through our “Resident Portal,” “Investor Portal” or “Contact
Community” features and later need to correct that information, please contact
us at marketing@lyonliving.com. Please note that if we cannot
associate the information to you, we may not be able to correct it.
Our
websites do not respond to “Do Not Track” signals.
Do Not Track (“DNT”) is a web browser setting that requests that a web
application disable its tracking of an individual user. When you choose to turn
on the DNT setting in your browser, your browser sends a special signal to
websites, analytics companies, ad networks, plug in providers, and other web
services you encounter while browsing to stop tracking your activity. Various
third parties are developing or have developed signals or other mechanisms for
the expression of consumer choice regarding the collection of information about
an individual consumer’s online activities over time and across third-party
websites or online services (e.g., browser do not track signals), but there is
no universally-agreed upon standard for what a company should do when it
detects a DNT signal. Currently, we do not monitor or take any action with
respect to these signals or other mechanisms.
Third
parties may collect personal information about you when you visit our websites.
When you visit
our websites, third parties can collect personal information about your online
activities over time and across different websites. This is because our websites use Google
Analytics which shares data with other Google services. Google may use the collected data to
contextualize and personalize the ads of its own advertising network. You can opt-out of having your data from
being collected and used by Google Analytics by installing the Google Analytics
opt-out browser add-on (compatible with Chrome, Safari, Firefox and Microsoft
Edge). The Google Analytics opt-out
browser add-on is available at https://tools.google.com/dlpage/gaoptout. To learn more about how Google uses
information from sites or apps that use its service, please see Google’s
Privacy Policy, which is accessible here:
https://policies.google.com/privacy.
Our websites
also contain Social Media plugins for Facebook, Instagram, LinkedIn, and Twitter. These buttons work by using code from the
social media companies that allows you to connect to them, and allows them to
collect information about your activity while you are on our website, including
your Internet Protocol address, the pages you visit, the device and browser you
are using, and more. The social media
companies can use the collected data to contextualize
and personalize ads they serve to you when you visit their sites. You can review the privacy policies of
these social media companies to learn more about the data they collect, and how
to manage or control the collection of data in your account settings.
Linking to other websites from
our websites.
Our websites
contain links to websites that are controlled by third parties and provide
access to third-party information and services.
These links are provided to you as a convenience, and we are not
responsible for the content, action or performance of any linked website. Please be aware that other websites have
their own privacy policies, and their data gathering practices may be different
from ours. We are not responsible for
the information collected by other websites if you link to them from our
website. We cannot guarantee how those
sites use cookies or whether they place cookies on your computer that may
identify you. You should carefully
review the privacy policies of each website you visit to understand how it
collects and uses information.
Security of your
personal information.
We have security
measures in place to protect against the loss, misuse, and alteration of website
visitor information which is under our control. Unfortunately, no security
system, or system of transmitting data over the Internet, can be guaranteed to
be 100% secure. As a result of the foregoing, while we strive to protect your
personal information, we cannot guarantee the security of our servers, the
means by which information is transmitted between your computer and our servers,
or any information provided to us or to any third party through or in
connection with our websites, and you provide all such information at your own
risk. Please do not provide us with
sensitive information (such as your Social Security Number) via e-mail.
Advertisements.
We do not
currently use any outside advertising company (“Advertiser”) to serve
advertisements on our websites. However,
we reserve the right to use an Advertiser to serve such advertisements in the
future. If so, please be advised that
such Advertisers may place cookies in your browser’s cookie file, which would
enable such Advertisers to record which ads your browser has seen, and which website
pages you may have been viewing when the ads were delivered. The information gathered by these cookies would
be viewable only by the Advertiser(s), and not by us.
What
if this Online Privacy Policy changes?
You always will
be able to determine when this Online Privacy Policy was last updated by
